Jury can't decide on Dunn murder charge Updated Feb 15, 2014 7:21 PM (CNN)

The Florida jury in the case of Michael Dunn has found him guilty on four charges, including three for attempted second-degree murder, but they couldn't reach a verdict on the most significant charge -- first-degree murder in the death of Jordan Davis.

After the decisions were read out Saturday night in court, Judge Russell Healey -- who moments before had said that the jury had reached a verdict on all counts -- declared a mistrial on the murder count.

This possibility had seemingly been floated around since 4:45 p.m. Saturday, when the 12 jurors sent a note saying they'd decided on four of the five counts that Dunn faces. But they hadn't unanimously reached a verdict "on count 1 or any of the lesser included offenses related to it."

Count 1 is first-degree murder for the shooting death of 17-year-old Davis.

Jurors could have decided not to convict Dunn on that charge but instead find him guilty on lesser charges such as manslaughter. Or they could have acquitted him altogether on this count.

Earlier Saturday, Healey acknowledged that the jury of four white women, two black women, four white men, an Asian woman and a Hispanic man was "struggling, obviously." Healey answered their questions at this point -- including "self-defense and justifiable use of deadly force applies separately to each count."

"But it's not for want of trying to reconcile all of this," he said then. "I think we've got some analytical people in there who are trying to do just that -- trying to analyze this from every possible angle."

Echoes of Trayvon Martin's death

It was November 23, 2012, when Michael Dunn pulled into a gas station in Jacksonville, parking next to a red SUV full of teenagers.

Loud music was coming from that car, and Dunn expressed his displeasure.

What came next is a subject of dispute. Clearly, there were words exchanged. And without doubt, Dunn ended up opening fire on the vehicle, killing Davis.

But did one of the teens flash a gun? Dunn says so, but prosecutors say that's not true -- pointing to the fact the teens were unarmed. And was the defendant acting in self-defense? Again, the two sides come to opposite conclusions.

Some have compared the Dunn case to the trial of George Zimmerman in the killing of Florida teenager Trayvon Martin, which, like the current trial, had racial overtones and claims of self-defense.

Martin's own parents have said as much, claiming Davis' killing is another reminder that in Florida, "racial profiling and stereotypes" may serve as the basis for illegitimate fear "and the shooting and killing of young teenagers."

But Dunn's defense attorney, Cory Strolla, told CNN's Chris Cuomo on Friday that the Zimmerman and Dunn cases aren't so similar.

There was a physical confrontation between Zimmerman and Martin, and police gave Zimmerman the benefit of the doubt about defending himself, Strolla said.

"My client did not wait to become that victim," he said. "My client did not wait to either get assaulted by a weapon or have someone potentially pull a trigger," he said.

Though a weapon was never found, Strolla maintains the youths could have had one. Dunn felt threatened and acted, he said.

"Now, does it sound irrational? Of course it sounds irrational. But have you ever been in that situation?" Strolla asked.

Given the attention and emotions tied to this case, a "comprehensive public safety plan" has been established ahead of a verdict, according to the Duval County joint information center handling the Dunn trial.

"All contingencies have been planned for," the statement said. "We will not discuss the specifics of any security plan. We will continue to protect the rights of those who choose to peaceably demonstrate."

Whatever the verdict, Davis' parents, Ron Davis and Lucia McBath, will never see their son again, they noted, adding, "We know that pain all too well. We walk with Jordan in defining his legacy to reflect our hopes by advancing love and tolerance in his memory, and continuing the fight against unjust gun laws."

"Tomorrow is my boy's 19th birthday," his mother tweeted Saturday. "I pray we will celebrate not only him but a just and righteous verdict. Patiently we wait."

Chris Brown "BREAKING NEWS" CNN reports probation revoked' Jail time?

LOS ANGELES (CNN)

A judge revoked Chris Brown's probation because of his October arrest in Washington, but the singer's not going to jail because he's already in a court-ordered residential rehab program.

Brown, who appeared before a Los Angeles County Superior Court judge Monday, must return for a hearing on Feb. 10 that will decide if he'll serve jail time after his three months in rehab.

The singer has an anger-management problem and drug-abuse issues, according to a probation report obtained by CNN.

He's been on felony probation since pleading guilty to beating up singer Rihanna on the eve of the Grammys in 2009.

Judge James Brandlin ordered Brown to check into a rehab program a month ago after he had been booted from another rehab facility a week earlier for smashing his mother's car window during a family session.

A report submitted to the judge by Brown's probation officer included a letter from his current rehab facility saying he "has made significant progress" since starting in the program on November 20.

"The clinical and medical team have witnessed very positive change in Mr. Brown since his psychotropic medications have been changed and he has been taken off medical marijuana," the program director said. "His ability to emotionally regulate himself has improved markedly."

"I'm pleased that he's doing well," Brandlin said Monday, explaining why he did not send him to jail Monday afternoon.

Brown was arrested on an assault charge in Washington on October 27. That case is why Brandlin ruled Monday that he was tentatively revoking Brown's probation for the Rihanna assault. He will decide in February if he will order Brown to complete his sentence in prison instead of probation.

Brown's girlfriend Karrueche Tran accompanied him to the Los Angeles County courtroom Monday. For the second time, his mother was not with him.

Brown's freedom has been in question since he was arrested on a sidewalk near the White House after allegedly punching a man.

The probation imposed when he pleaded guilty to a felony charge in the attack on Rihanna -- his girlfriend at the time -- requires that he stay out of legal trouble.

Brown voluntarily entered a rehab center on October 28, a day after he was released from a Washington jail.

The probation report given to the judge last month revealed that he was kicked out of the program. It quoted a center official saying he was ordered out for "breaking program rules by acting violently."

The violence involved Brown "throwing a rock through his mother's car window" after a family session at the center in which she said she wanted him to stay in treatment.

"Mr. Brown preceded to walk outside and pick up a rock and threw it through his mother's car window and it shattered," according to letter from the rehab center included in the probation report.

Brown's "prognosis is very guarded" unless he gets professional help, the letter said.

Brown leaves the new rehab center three days a week to work eight-hour shifts of community labor so that he can complete the 1,000 hours of work still remaining in his punishment for attacking Rihanna. The report estimated he will have to work on community labor three days of every week until next August to meet the deadline for completing the labor.

He may also travel to Washington for a court hearing on Jan. 8 in the assault case there, the judge said.

Zimmerman arrested for domestic violence

George Zimmerman was charged Monday with aggravated assault, domestic violence battery and criminal mischief, after an incident at his girlfriend's home in central Florida, said Dennis Lemma, chief deputy with the Seminole County Sheriff's Office.

Zimmerman, who was acquitted earlier this year of murdering teenager Trayvon Martin, was arrested Monday after he allegedly pointed a shotgun at his girlfriend, a spokesman for the Seminole County Sheriff's Office said.

George Zimmerman arrested in Florida
(CNN) -- George Zimmerman was arrested Monday afternoon in central Florida "after deputies responded to a disturbance call," the Seminole County Sheriff's Office said in a news release.
Further details about Zimmerman's arrest in Apopka, Florida, were not immediately released. He will be booked at the county's correctional facility, the sheriff's office said.
This is one of several brushes that Zimmerman has had with law enforcement since he was acquitted this year of murder and manslaughter in the 2012 shooting death of teenager Trayvon Martin.
Earlier this month, police in Lake Mary, Florida, said no charges will result from an alleged domestic dispute in September between George Zimmerman and his estranged wife, Shellie Zimmerman.
Shellie Zimmerman said in September that she has doubts about his innocence in the Trayvon Martin case.
Since his acquittal in the Martin case, Zimmerman also has been stopped for speeding twice. He was pulled over the first time in Forney, Texas, in July and told the police officer he had a concealed weapon permit and a gun in his glove compartment. The officer wrote on his incident report that he gave Zimmerman a verbal warning.
Zimmerman was pulled over in early September going 60 mph in a 45-mph zone in Lake Mary and received a $256 ticket. He was not carrying a weapon at the time.
His attorney in the murder trial, Mark O'Mara, no longer represents him.

AEG not liable in Michael Jackson's civil trial

A Los Angeles jury decided Wednesday that AEG Live hired Dr. Conrad Murray, but also concluded that the concert promoter was not liable for Michael Jackson's drug overdose death.

The jury decided that Murray was competent, so even though AEG Live hired him, it was not liable for Jackson's death and didn't owe the Jackson family millions of dollars in compensation.

"I counted Michael Jackson a creative partner and a friend," the company's CEO Randy Phillips said. "We lost one of the world's greatest musical geniuses, but I am relieved and deeply grateful that the jury recognized that neither I, nor anyone else at AEG Live, played any part in Michael's tragic death."

The verdict brings the five-month-long trial to a close.

"We have said from the beginning that this case was a search for the truth. We found the truth. AEG hired Dr. Conrad Murray, the man who is in jail for killing Michael Jackson," according to a statement from family matriarch Katherine Jackson and her lawyers. "All options regarding the balance of the jury verdict are being considered."

The jury accepted AEG Live lawyers' arguments that the company was not negligent because its executives had no way of knowing that Murray -- licensed to practice in four states and never sued for malpractice -- was a risk to Jackson. The singer was a secretive drug addict who kept even his closest relatives in the dark about his use of propofol to sleep, they contended.

Jackson's mother and the singer's three children sued AEG Live in 2010, arguing that the company's negligence in hiring, retaining or supervising Murray was a factor in the singer's June 25, 2009, death.

Jackson died of an overdose of the surgical anesthetic propofol, which Murray told investigators he was using to treat the singer's insomnia so he could rest for rehearsals. Murray is set to be released from jail later this month after serving two years for involuntary manslaughter.

Jackson died just days before his comeback tour -- promoted and produced by AEG Live -- was set to debut in London in the summer of 2009.

"We felt (Murray) was competent" to be Jackson's general practitioner, said juror Greg Barden. "That doesn't mean we felt he was ethical."

Barden said jurors thought the second question -- which said, "Was Dr. Conrad Murray unfit or incompetent to perform the work for which he was hired?" -- was confusing and took some time, and several votes, to work out. In the end, they voted 10-2 to answer "No."

He said one of the key pieces of evidence was the contract between Murray and AEG.

"The jury's decision completely vindicates AEG Live, confirming what we have known from the start -- that although Michael Jackson's death was a terrible tragedy, it was not a tragedy of AEG Live's making," attorney Marvin Putnam said in a written statement.

Murray's lawyer, Valerie Wass, let out a gasp when she heard the decision and was visibly shaken.

Because jurors concluded that AEG Live was not liable, they did not consider other questions on the verdict form that would have determined how much in damages the promoter would have paid Katherine, Prince, Paris and Blanket Jackson.

Jackson lead lawyer Brian Panish suggested a range between $1 billion and $2 billion to replace the earnings lost by Jackson's death at age 50 and the non-economic -- or personal -- damages from the loss of a father and son.

The damage award, however, would have been reduced by the percentage of blame jurors decided Michael Jackson shared in his death. The Jacksons lawyer suggested in closing arguments that they assign 20% of the liability to Jackson.

AEG's lawyers had contended Jackson chose Murray, who had treated him for three years as a family physician, but Jackson lawyers had argued the promoters chose to negotiate their own contract with the doctor so they could control him.

The case is unlikely to end with the jury's verdict because Jackson lawyers have said they have grounds for an appeal, which could take years to decide.

Jurors appeared engaged and entertained during the 21-week trial that included dramatic testimony by Jackson's mother, son and former wife.
